1.2. These Conditions, accepted by the Buyer (i.e. having read the Terms & Conditions of Purchase and Sale of Items and checking the box to "I understand and agree to the Terms & Conditions of Purchase and Sale of Goods"), is a binding legal document for parties that establish the rights and obligations of the buyer and seller, the purchase of goods and payment for them, order of delivery and return of goods, liability of parties and other conditions related to purchase-sale in auksosala.lt online store.
1.3. The right to Buy in our online store has:
1.3.1. legal entities;
1.3.2. capable persons, those who are adults, whose capacity is not restricted in accordance with the procedure established by law;
1.3.3. minors aged 14 to 18, but only with the consent of their parents or guardians, unless they are self-disposable;
1.3.4. all no. 1.3.1-1.3.3. authorized representatives of specified persons.
1.4. The Buyer, accepting the Terms, confirms that, in accordance with Terms no. 1.3, has the right to purchase goods at the auksosala.lt online store.
3.2. By accepting these Conditions, the Buyer confirms that he agrees that personal data specified by him, in accordance with the procedure established by legal acts, would be processed by selling the goods online for auksosala.lt purposes.
3.3. The seller does not disclose information from the buyer and does not distribute it. However, the seller reserves the right to provide the consumer with information about new products, special offers, vendor partners, information about the goods and services sold, and use this information for the analysis of the vendor's activity and for direct marketing purposes (unless the buyer indicates that he does not accept that his personal data would be usede for direct marketing purposes). The buyer's information may be disclosed only: 1. upon receipt of the Buyer's consent; 2. if required by law or in the course of enforcement of the judgment; 3. if the uyer has violated or failed to comply with the Terms and Conditions for the purchase of goods; 4. if the disclosure of information is necessary in order to recover the Buyer's debt or recovery losses, 5. in other cases stipulated by law. The seller reserves the right to disclose information to the vendor's partners in accordance with these Terms and Conditions and legal acts.
3.4. The buyer, visiting auksosala.lt website, agrees that the buyer's computer will record cookies that are required to capture the site's traffic and display advertisements for marketing purposes. Cookies do not show a specific person, but only calculate site visitor stats.
3.5. The seller has the right to require from a customer to show his identification document for the person delivering the goods, the trader or the postal worker.
4.2. The seller retains the right to keep the purchase agreement not formed if the buyer does not specify all the necessary data or parameters for delivery or ordered goods, perform incomplete or partial payment or for other objective reasons for these Terms and Conditions, the contract of sale can not be concluded.
5.2. The Buyer has the right to cancel the Purchase and Sale Agreement concluded with the auksosala.lt website, by contacting the seller and obtaining the return code and the instruction within 14 (fourteen) days from the delivery date of the goods. The Return Guarantee does not apply to the Customers' Custom Made Items.
5.3. The buyer may only use the right provided in no. 5.2 of the Terms if the goods are not damaged, used, worn, labels are on and Lithuanian Assay Office sertificate is not torn off (if there was one), the item is in the original packaging and the buyer has all the original documents.
5.4. The buyer is required to pay for the goods and accept them in accordance with the terms and conditions of these Terms.
5.5. The registered buyer undertakes not to transfer to third parties their login data. If the buyer loses access to the data, he / she must immediately inform the seller in the "Contact" section of the means of communication indicated here.
5.6. If the data submitted by the registered buyer changes in the registration form, he / she must immediately update them.
5.7. The Buyer, using the auksosala.lt online store, undertakes to comply with these Conditions, other rules specified in the online store and not to violate the applicable law.
5.8. The buyer undertakes to carefully read the description of the product. Buyer agrees with the provided specification of the product, description and other purchase information for the purchase.
5.9. The buyer understands that the parameters of the precious gemstone fixed on the website (for example, the color of the brilliant color or clarity) may differ in some cases from the parameters given to the gemstone or product of the Lithuanian Assay Office for the reason that the Lithuanian Assay Office estimates the probability of an error of 20% for evaluation of the products.
5.10. The ring size can be changed if the ring design allows it (i.e. the ring does not have side stones, etc.). The vendor informs the buyer about the change of the ring size.
6.2. If the buyer attempts to harm the stability and security of the online store or breaches its obligations, the seller has the right to immediately or without warning restrict or stop him from using the online store or, in certain cases, to cancel the buyer's registration.
6.3. For important reasons, the seller may terminate the online store temporarily or in whole without notifying the buyer without prior notice.
6.4. The seller has the right without prior notice to the buyer to cancel his order if the buyer does not provide all the necessary data for the order and it is not possible to contact the buyer by telephone or e-mail indicated by him, as well, if full payment has not been made. The time limit for delivery of goods in this case starts to run from the moment all information is submitted and / or paid. The seller has the right to cancel his order in advance, without telling the buyer, if the seller fails to contact the buyer within three (3) business days.
6.5. The seller undertakes to respect the buyer's right to the security of his data and to use the buyer's data only in accordance with these Terms and Conditions and applicable law.
6.6. The seller undertakes to deliver the goods ordered by the buyer to the address indicated by the buyer in accordance with the procedure set out in these Conditions.
6.7. The seller, due to important circumstances, unable to deliver the goods ordered to the buyer, undertakes to offer a similar or, as far as possible, a product comparable to its characteristics. If the buyer refuses to accept the most similar product with the same or similar characteristics, the seller undertakes to return the money paid to the buyer within seven (7) business days if the payment has been made.
7.2. The buyer pays for the goods at the time of placing the order through the Paysera system, via a credit card or via the PayPal system.
7.3. The seller reserves the right not to execute the order if there is an incomplete order or payment information or a partial payment has been made.
7.4. The Buyer, accepting the Terms, agrees that the documents for the purchase of the goods will be presented to him at the time of delivery or picking up at the store. When a buyer makes an order, he creates a personal account (if he chooses to create one) and can print information related to prepayment. The buyer's personal account details the selected items, their quantity, discounts, the final price of the goods, delivery charges, and other charges and other necessary information for accounting.
7.5. The buyer and the seller agree that after the customer has submitted the order for the item and after confirmation by the seller, the price of the item may change depending on the objective factors affecting the price of the product, such as the increase in the cost of the product, the technical error of the information systems, additional costs related to the sale of the goods to the buyer (LR CK 6.313 part 7). In this case, if the buyer refuses to purchase the item at a new price, either party, after giving notice of this other country, has the right to terminate the contract of sale of the goods. The parties agree that the losses related to the termination of the sales contract in accordance with the procedure provided for in this item are not reimbursed.
8.2. The buyer undertakes to indicate the exact place of delivery of the goods.
8.3. The buyer undertakes to accept the goods himself. In the case when he / she can not accept the goods himself, and the goods are delivered to the specified address, the buyer is not entitled to convey the claims to the seller regarding the delivery of the goods to an unfit entity. Accordingly, when goods are delivered to the address indicated by the buyer, the goods will be deemed to be duly served to the buyer.
8.4. The seller delivers the goods to the buyer in accordance with the terms of the product descriptions and the auksosala.lt. These terms are provisional, and do not apply in cases where the seller's store does not have the required goods. At the same time, the buyer agrees that the delivery of the goods may be delayed due to unforeseen circumstances beyond the seller's control.
8.5. In all cases, the seller is released from liability for the violation of delivery terms if the goods are not delivered to the buyer or delivered in a timely manner due to the fault of the buyer or due to circumstances beyond the seller's control.
8.6. During the presentation of the goods to the buyer, the buyer must, together with the seller or his authorized representative, check the condition of the consignment and the goods (s) and sign the transfer-acceptance document of the consignment. After the buyer signs the transfer-acceptance document of the consignment, the consignment is considered to be in good condition, there are no violations of the goods, the basis of which is attributable not to the manufacturer's brochure, and the lack of conformity of the goods (which can be determined during the external inspection of the goods). If the product has been found to be damaged (wrinkled, wet or otherwise externally damaged), the product (s) are damaged and / or the item (s) are inadequate, the buyer must indicate this in the transfer / acceptance document of the consignment and / , in the presence of the seller or his representative, write a free-form batch and / or a violation / non-compliance of the item (s). If the buyer fails to do so, the seller is exempted from liability to the buyer for defective goods if these discrepancies can be detected during the external inspection of the goods and, accordingly, the goods are considered to be in good condition and quality.
8.7. At the buyer's request, the buyer can pick up the goods at the address indicated by the seller. After the buyer withdraws the goods at the address indicated by the seller, the goods are deemed to be duly delivered to the buyer and are in accordance with the agreed requirements of the parties. Such withdrawal from the seller shall be subject to the conditions provided for in Term no. 8 of the Conditions relating to delivery of goods, inspection, and withdrawal.
9.2. The seller is not responsible for the fact that the goods in the online store may not correspond to the actual size, shape and color of the goods in terms of color, shape or other parameters due to the characteristics of the monitor used by the buyer.
9.3. The parameters of the gemstone that is fixed on the website (for example, the color of the diamond, weight or clarity) may differ in some cases from the parameters given to the gemstone or product of the Lithuanian Assay Office, because the Lithuanian Assay Office estimates the probability of an error of 20% for evaluation of the products.
9.4. In the event that the seller does not provide or warrant a warranty on the quality of the product, the guarantee provided for in the relevant legislation is in effect.
10.2. The following conditions must be fulfilled by the buyer when returning the goods:
10.2.1. the return item must be in the original order packaging;
10.2.2. the product must be intact;
10.2.3. the product must not be used, it has not lost its appearance (unbreaked and unoptimized labels, unlabeled label and certificate of the product installed by the Lithuanian Assay Office, international certificates presented, if any, etc.).
10.2.4. the return item must be the same as the one purchased by the buyer
10.2.5. When returning the goods, it is necessary to submit a document for its purchase, all the certificates that were submitted with the goods;
10.2.6. Return of the goods requires the seller's refund code.
10.3. The seller has the right not to accept returns from the buyer if the buyer does not comply with the return procedure of this article or if the return item does not meet the specified repayment requirements. Damaged, modified, altered or used goods are not accepted for return. Items will also not be accepted for return if the buyer does not have a return code, the package is damaged, there are missing parts of the package or accessories delivered with the goods. In the event that the original quality certificate is missing, the label is damaged or torn off, the seller reserves the right to demand payment of the re-certification for the product or to refuse to accept such a return.
10.4. The buyer pays for the return of the goods of the right quality. Returned goods must be sent by registered mail and at the time of transport, at a full cost, not less than the purchase price of the item or delivered to the auksosala.lt points of sale.
10.5. The money is returned when the seller inspects the returned product and is satisfied that the goods are intact and meet the conditions for return. Money for returned goods is in all cases returned to the payer only.
10.6. The return is carried out on the basis of the Minister of Economy of the Republic of Lithuania in 2001. August 17 Order No 258 approved "Rules for the sale of goods and provision of services when contracts are made using communication facilities" in accordance with the established procedure and in 2013. December 19 the Civil Code Code of Amending and Supplementing the Law no. XII-700. Goods may be returned within 14 days from the date of their receipt, only in the original packaging and with the certificate of the Lithuanian Assay Office (not torn off form the product).
11.2. The buyer is responsible for the actions taken using this online store.
11.3. The registered buyer is responsible for transferring his / her login data to third parties. If the services provided by auksosala.lt are used by a third party, when you login to the online store using the customer's login details, the seller considers the person as a buyer.
11.4. The seller is exempted from any liability in the event that the loss arises from the fact that the buyer, without taking into account the seller's recommendations and obligations, did not comply with these Terms and Conditions, although such an opportunity has been granted to him.
11.5. If the seller's online store contains links to web sites of other companies, institutions, organizations or individuals, the seller is not responsible for the information contained therein, they do not supervise, control, and do not represent these companies and / or individuals.
11.6. In the event of damage, the damaged party will reimburse the other party for direct losses.
11.7. The parties expressly agree that the seller is not liable for the loss or material and non-material damage caused by the delayed delivery of the goods, not delivered goods, cancellation of the order or non-conformity of the goods. In case of non-delivery or cancellation of a customer's order, the sole seller's duty is to return the money paid to the buyer for the goods.
12.2. The seller is entitled to unilaterally, without notice, to change the terms of the shares, as well as to cancel them.
13.2. The Seller makes every effort to ensure that the information contained in the website is accurate and complete. To give the buyer the opportunity to view the products as detailed as possible, different pictures are added. Some products may appear larger or smaller than actual size in photos, may vary in color, shape or shade, and, accordingly, the product delivered may have some discrepancies in comparison with the photo.
15.2. These Terms and Conditions are made in accordance with the legal acts of the Republic of Lithuania. Conditional relations are governed by the law of the Republic of Lithuania. All disputes arising out of violation of these Terms are resolved by negotiation. If the parties fail to agree, disputes shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania. The buyer has the ability to resolve the dispute electronically via the EGS platform ec.europa.eu/odr/.
15.3. These Terms are the intellectual property of the seller. In addition to the written consent of the seller, it is prohibited to copy, distribute or use the Terms or any part thereof.
