This Privacy Policy (hereinafter – the “Policy”), together with the terms of use of the auksosala.lt website auksosala.lt/lt/pirkimo-salygos, governs the use of the UAB “Aukso Sala” (hereinafter – the “Company”) website by customers/visitors (hereinafter – the “User”).
This Policy provides information on how the Company collects, uses, stores and processes the User’s personal data, therefore please read this Policy carefully before using the services of auksosala.lt. By registering and placing orders on the Company’s website, you must confirm that you have read and understood this Policy as well as the Purchase Terms and that you unconditionally agree to comply with them.
If you do not agree with this Policy and/or the Purchase Terms, we recommend that you do not use the auksosala.lt website.

New law
1.1. Since the start of the Company’s operations, we have taken care of the security of the User’s personal data, therefore there have been no radical changes in the Company’s activities. With the entry into force of the new regulation, the Company only needed to supplement the User’s rights with newly introduced rights. The Company will continue to comply with all of the following principles of processing and protecting the User’s personal data:
1.1.1. To process the User’s personal data lawfully, fairly and transparently (principle of lawfulness, fairness and transparency);
1.1.2 To collect the User’s personal data for specified, explicit and legitimate purposes and not further process it in a manner incompatible with those purposes (principle of purpose limitation);
1.1.3. To ensure that the processed User’s personal data is adequate, relevant and limited to what is necessary in relation to the purposes for which it is processed (principle of data minimisation);
1.1.4. To ensure that the User’s personal data is accurate and, where necessary, kept up to date; to take all reasonable steps to ensure that personal data that is inaccurate, having regard to the purposes for which it is processed, is erased or rectified without delay (principle of accuracy);
1.1.5. To keep the User’s personal data in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data is processed (principle of storage limitation);
1.1.6. To process the User’s personal data in a manner that ensures appropriate security of personal data through appropriate technical or organisational measures, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage (principle of integrity and confidentiality).
Personal data that is not collected or processed
2.1. We do not collect or store Users’ browsing history on third-party websites;
2.2. We do not transfer any data about the User’s browsing on the Company’s website from which the User could be identified;
Data collected and processed
3.1. We collect and process only adequate and relevant User personal data that is necessary to achieve the purposes for which it is processed.
3.2. User personal data that we collect and process:
3.2.1. When you shop in the Company’s online store auksosala.lt without creating an individual account, i.e., as a Guest, for the purpose of concluding and performing a contract and on a legal basis, the Company collects the following User personal data:

3.3. User personal data that we collect and process when the User creates an account in the Company’s online store but does not make a purchase, i.e., registration data. This data processing is carried out under the service provision terms agreement concluded between the Company and the User.
3.3.1. To make shopping in the Company’s online store auksosala.lt as convenient and fast as possible, you may create a personal account. After the User creates a personal account, the Company collects and processes the following data:
First name; Last name; Email address; Delivery address; Phone number; IP address.
3.4. We collect and process User personal data that you have provided to the Company voluntarily:
3.4.1. When creating an account in the Company’s online store auksosala.lt, the User may provide additional personal data at their own discretion:
Gender; Date of birth; Saved payment card details in the personal account; Second home or mobile phone number.
3.5. User personal data collected and processed by the Company for communication purposes on the basis of the agreement on the use of the auksosala.lt website concluded between the User and the Company:
3.5.1. If the User chooses to receive marketing offers from the Company and third parties and/or chooses to communicate with the Company via the communication methods provided by it, the following data is collected:

3.5.2. The Company grants the User the right/opportunity to manage all optional types of communication provided by the Company, including login and payment options.

3.6. On the basis of the conditions for concluding the service provision agreement between the User and the Company, when the User contacts the Company for assistance, the Company processes and collects the following data:
3.6.1. When the User submits a review, complaint and/or requests assistance from the Company, the Company may collect the following User data:

3.7. In order to improve the User’s browsing experience in the auksosala.lt online store, the Company analyses the User’s actions and, on the basis of legitimate interest, processes the following User personal data:

3.8. For marketing purposes, in order to provide promotional offers, newsletters, etc., upon the User’s consent, the Company processes the following data:

3.9. Other personal data that we collect and process when the User uses the Company’s online store:
3.9.1. When the User visits and/or shops in the Company’s online store, for the User’s convenience, the Company also collects and processes the following data on the basis of the User’s consent:
Purchase history; Behaviour history in the online store; IP address; Payment history; Communication history between the User and the Company, including electronic correspondence; Basic information about third parties receiving the goods.
3.9.2. You may indicate another person who will collect the goods purchased by the User if such person has given their consent. By providing the Company with information about third parties collecting the goods, the User confirms that they have such persons’ consent for the transfer, use and processing of their personal data.
Purposes of collection, processing and storage of the User’s personal data
4.1. The Company collects the User’s personal data only for specified, explicit and legitimate purposes and does not further process it in a manner incompatible with those purposes.
4.2. User personal data processed for the purpose of preparing to conclude a contract:
4.2.1. When the User creates a personal account in the Company’s online store but does not purchase anything, the User may return to it at any time and continue shopping/browsing without having to register again. In order to enable the User to continue a purchase at any time, the Company collects and processes the following User personal data:

4.2.2. For this purpose, the User may also provide additional personal data, which the Company will process only if the User enters and saves it in their personal account.
4.3. User personal data processed for the purpose of concluding and performing a contract:
4.3.1. In order for the Company to sell the goods selected by the User in the auksosala.lt online store, it is necessary for the Company to process the following User personal data:
First name; Last name; Phone number; Email address; Delivery address; IP address; Delivery method; Payment method; Payment information.
4.3.2. We regret to inform you that if the User does not provide this personal data, the Company will not be able to sell the goods, as processing this data is necessary for the conclusion and performance of the contract, and the Company is also obliged to process personal data under the legal acts of the Republic of Lithuania governing online payments and accounting.
4.4. User personal data processed for the purpose of service improvement and activity analysis:
4.4.1. We want the use of the Company’s online store auksosala.lt to be as simple and convenient as possible for the User, therefore we carry out continuous operational analysis during which we analyse and process the following User personal data:
Purchase history; Browsing history in the auksosala.lt online store; Reviews of purchased goods; Communication history between the Company and the User, including electronic correspondence.
4.5. User personal data processed for the purpose of providing general and individualised offers and profiling:
4.5.1. In order to provide the User with general offers regarding goods and regarding lotteries, promotions, projects organised by the Company, we process the following User personal data:

4.5.2. The User has the right at any time to refuse the processing of the User’s personal data by the Company for the purpose of general and individualised offers regarding goods and regarding lotteries, promotions, projects organised by the Company. To refuse the processing for the above purpose, the User may submit a refusal to the Company in writing or by email to info@auksosala.lt
4.6. User personal data processed for the purpose of examining User requests, complaints and questions:
4.7. In order to provide quality services and ensure comprehensive service, we also process the personal data you provided when creating a personal account and shopping, as well as for the purpose of examining questions, complaints and requests.
4.8. In order to ensure the safety of Users and Company employees, as well as to protect against theft of goods in physical stores and collection points, the Company has installed surveillance cameras. When Users visit the Company’s stores or goods collection points, you are being filmed. We review video recordings in the event of incidents, thefts or other criminal acts in order to protect the legitimate interests of injured persons.
Are my personal data collected and processed lawfully?
5.1. We ensure that we collect and process the User’s personal data only on lawful grounds, i.e., we collect and process the User’s personal data only:
5.1.1. When purchasing goods, a purchase–sale agreement is concluded between the User and the Company and we process Users’ data on this basis;
5.1.2. When registering in the auksosala.lt online store and creating a personal account, we process Users’ data in preparation to purchase goods in the future;
5.1.3. Upon consent to process the User’s personal data;
5.1.4. In compliance with the requirements of laws applicable to the Company;
5.1.5. When required by authorised state institutions.
Can I refuse the processing of my personal data and still use the AUKSOSALA.LT online store?
6.1. The User has the right at any time to object to the processing of the User’s personal data where the processing is based on the User’s consent. However, without the mandatory data, we are not able to complete the User’s purchase, because the Company would not be able to fulfil the order conditions.
Transfer of personal data
7.1. The User’s personal data is transferred only to reliable third parties with whom we have concluded agreements and only to the extent necessary to provide the service. For the purpose of proper provision of services, we transfer the User’s personal data to the following partners:
7.1.1. Courier service companies that deliver goods to the addresses specified by the User;
7.1.2. Suppliers of goods who deliver goods directly;
7.2. We also provide the User’s personal data to:
7.2.1. Law enforcement authorities in accordance with the procedure established by the legal acts of the Republic of Lithuania;
7.2.2. State authorities and courts where such obligation is established by applicable legal acts.
7.2. We inform you that the User’s personal data may be transferred outside the European Economic Area (hereinafter – the “EEA”). The User’s personal data is transferred outside the EEA if the following conditions are met:
7.2.1. Data is transferred only to the Company’s trusted partners ensuring the provision of our services to the User;
7.2.2. Data processing agreements have been signed with such partners, by which they ensure the security of the User’s personal data in accordance with legal requirements;
7.2.3. The European Commission has adopted an adequacy decision regarding the country where our partner is established, i.e., an adequate level of protection is ensured;
7.2.3. Partners ensure the level of security of the User’s personal data under the “EU–US Privacy Shield”.
Retention period of the User’s personal data
8.1. The User’s personal data is stored for as long as necessary to perform the purchase agreement, but not for a shorter period than the Company is obliged to do so by legal acts governing the Company’s activities. The User’s personal data processed on the basis of the User’s consent is processed and stored until the day the User withdraws the consent.
How can I access my personal data being processed?
9.1. The User has the right to access the User’s personal data processed by the Company. You can access your personal data in the following ways:

Amendment and correction of personal data
10.1. If you notice that the User’s personal data is inaccurate or incomplete and you wish to change or correct it, you can do so in the following ways:

Can I request that you delete my personal data?
11.1. The User has the right to request that the Company no longer processes the User’s personal data and deletes it. The User’s personal data will be deleted upon receipt of the User’s request.
11.2. The User’s personal data will not be deleted from the Company’s database if, after receiving the User’s request, we determine that:
11.2.1. The User’s personal data is necessary to achieve the purposes for which it was collected or processed;
11.2.2. The User has not withdrawn consent for the processing of the User’s personal data;
11.2.3. The User objected to the processing of the User’s personal data, but such processing is necessary due to the Company’s legitimate interests;
11.2.4. The Company is obliged to process the User’s personal data by applicable European Union and national legal acts.
11.2.5. The Company needs to process the User’s data for the establishment, exercise or defence of legal claims.

Restrictions on the right to process personal data
12.1. The User has the right to restrict the Company’s ability to process the User’s personal data. If the User restricts the processing of the User’s personal data, the Company will no longer perform any actions with the User’s personal data other than storing it. You may restrict the processing of personal data if at least one of the following circumstances applies:
12.1.1. The User’s personal data is inaccurate (processing actions will be restricted until the accuracy of the data is verified);
12.1.2. The User’s personal data is processed unlawfully, but you do not agree that the User’s data should be deleted;
12.1.3. The User’s personal data is necessary for the establishment, exercise or defence of legal claims;
12.1.4. The User’s personal data is processed where the User has objected to such processing (processing will be restricted on this basis until it is verified whether the reasons for which the Company processes the User’s personal data override those of the User).

What is the right to data portability? How can I use it?
14.1. The right to data portability means that the User is allowed to receive the personal data provided by you, which the Company processes by automated means, in a structured, commonly used, machine-readable and interoperable format. Where technically feasible and at the User’s request, such User data may be transmitted directly to another person indicated by the User.
14.2. You can submit a request for the provision or transmission of the User’s personal data in a structured format in the following ways:

Submitting a request to exercise rights
15.1. You may submit requests related to the processing of the User’s personal data to the Company in the following ways:

15.2. In our system, we identify the User by the User’s email address. When submitting a request to the Company by any of the methods specified above, always indicate the email address in respect of which the request is submitted. If the User does not indicate an email address, or if it does not match the email address of the person submitting the request, we will not be able to properly identify the User and provide the requested information or implement the User’s request.
15.2.1. If the User believes that the User’s rights have been violated, the User may contact the State Data Protection Inspectorate to defend their rights.
Cookies
16.1. Cookies are small text files that are downloaded to the User’s device when the User visits a particular website. Cookies help the Company recognise the User’s device and help improve the functionality of the Company’s website and make it easier to use. The Company also uses cookies to personalise the User’s browsing experience and displayed content and to provide offers that are relevant specifically to the User. Cookies are used to analyse the User’s browsing history and this data is used to enable the User to use the Company’s services, for statistical analysis purposes, and to provide the User with commercial and advertising offers. 16.3.2. It is important to know that it will not be possible to use the website if you refuse technical, functional and analytics cookies; therefore, we do not recommend deleting or blocking cookies.
Other provisions
17.1. This Policy may be updated by the Company. The Company will inform the User about updates by publishing a new version of the Policy on the website together with the dates of the amendments made.
17.2. Users understand that by continuing to use the website after updates to the Policy, they confirm that they have read and do not object to future changes.
